General Terms and Conditions for Accommodation Contracts

Article 1 - Scope of Application

  1. 01.01. 1.Accommodation Contracts and related agreements to be entered into between the Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations and/or generally accepted practices.
  2. 01.02. 2. In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the preceding paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

Article 2 - Application for Accommodation Contracts

  1. 02.01. 1. The Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
    1. Name(s) of Guest(s) to be registered;
    2. Date(s) of accommodation and estimated time of arrival;
    3. Accommodation charges (based, in principle, on the basic accommodation charges listed in the attached Schedule I); and
    4. Other particulars deemed necessary by the Hotel.
  2. 02.02. In the case when the Guest has requested, during his/her stay, an extension of accommodation beyond the date described in the preceding paragraph (2) above, the Hotel shall handle his/her request as an application for a new Accommodation Contract at the time such request is made.

Article 3 - Conclusion of Accommodation Contracts

  1. 03.01. The Accommodation Contract shall be deemed to have been concluded when the Hotel has accepted the application as stipulated in the preceding article. However, the same shall not apply when it has been proved that the Hotel has not accepted the application.
  2. 03.02. When an Accommodation Contract has been concluded in accordance with the provisions of the preceding paragraph, the Guest shall pay an accommodation deposit set by the Hotel within the limits of the Basic Accommodation Charge covering the Guest's entire period of stay (three days when the period of stay exceeds three days) not later than the date specified by the Hotel.
  3. 03.03. The deposit shall be first applied to the final payment of the Accommodation Charges to be paid by the Guest, then secondly to the cancellation charges under Article 6 and thirdly to the reparations under Article 18 as applicable, and the remainder, if any, shall be refunded at the time of payments of the Accommodation Charges as stated in Article 12.
  4. 03.04. When the Guest has failed to pay the deposit by the date specified by the Hotel as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of payment of the deposit is specified.

Article 4 - Special Contract Requiring No Accommodation Deposit

  1. 04.01. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may enter into a special contract requiring no accommodation deposit as stipulated in the same paragraph after the conclusion of the Contract.
  2. 04.02. 2.In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding article and/or has not specified the date of payment of the deposit at the time an application for the Accommodation Contract has been accepted, it shall be treated as that the Hotel has accepted a special contract prescribed in the preceding paragraph.

Article 5 - Refusal of Conclusion of Accommodation Contracts

  1. 05.01. The Hotel may not accept the conclusion of the Accommodation Contract under any of the following cases:
    1. When an application for accommodation does not conform to the provisions of these Terms and Conditions;
    2. When the Hotel is fully booked and no room is available;
    3. When the Guest seeking accommodation is deemed likely to conduct himself/ herself in a manner that will contravene laws, public order or good morals in regard to his/her accommodation;
    4. When the Guest seeking accommodation is deemed to fall under any of the following (a) through (c);
      1. An organized crime group as defined by Article 2, Item 2, of the Act to Prevent Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as "Gang Group"), a member of an organized criminal group as defined by Article 2, Item 6, of said act ("Gang Member"), a quasi-member of or a person related to a Gang Group or other such antisocial groups
      2. a corporation or other organization whose business activities are controlled by a Gang Group or Gang Members
      3. A corporation that has a person determined to be a Gang Member as a board member
    5. When the behavior of the Guest seeking accommodation has caused considerable trouble to other guests;
    6. When the Guest seeking accommodation can be clearly detected as carrying an infectious disease;
    7. When demands are made by violent means, or the Hotel is required to assume a burden beyond a reasonable extent in respect to accommodation;
    8. When the Hotel is unable to provide accommodation due to natural calamities, dysfunction of the facilities and/or other unavoidable causes;
    9. When the Guest seeking accommodation fails to notify the Hotel of the matters stipulated in Article 6, Paragraph 1, of the Act when required.

    10. When the Guest seeking accommodation threatens violence, uses threats or extortion, or makes an unreasonable or coercive request to the Hotel or staff members (employees), or requires the Hotel to assume a burden beyond a reasonable extent. Or when the Guest seeking accommodation is deemed to have acted previously in such a manner.

Article 6 - Right of the Guest to Cancel Accommodation Contracts

  1. 06.01. The Guest is entitled to cancel the Accommodation Contract by so notifying the Hotel.
  2. 06.02. In the case when the Guest has cancelled an Accommodation Contract in whole or in part for causes attributable to the Guest (except in the case when the Hotel has requested the payment of a deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled before the payment), the Guest shall pay cancellation charges as listed in the attached Schedule II. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed, when such special contract is concluded, of the obligation of payment of cancellation charges in the case of cancellation by the Guest.
  3. 06.03. In the case when the Guest does not appear by 8:00 p.m. on the date of accommodation (when 2 hours have passed since the expected time of arrival if the Hotel is notified of it in advance) without an advance notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest and will handle it accordingly.

Article 7 - Right of the Hotel to Cancel Accommodation Contracts

  1. 07.01. The Hotel may cancel the Accommodation Contract under any of the following cases:
    1. When the Guest is deemed liable to conduct and/or has conducted himself in a manner that will contravene the laws or act against the public order and good morals in regard to his accommodation;
    2. When the Guest seeking accommodation is deemed to fall under any of the following (a) through (c);
      1. a Gang Group, a Gang Member, a quasi-member of or a person related to a Gang Group or other such antisocial groups
      2. a corporation or other organization whose business activities are controlled by a Gang Group or Gang Members
      3. A corporation that has a person determined to be a Gang Member as a board member
    3. When the behavior of the Guest has caused considerable trouble to other guests;
    4. When the Guest is clearly detected as carrying an infectious disease;
    5. When demands are made by violent means, or the Hotel is required to assume a burden beyond a reasonable extent in respect to accommodation;
    6. When the Hotel is unable to provide accommodation due to natural disaster or other force majeure events;
    7. When the Guest seeking accommodation fails to notify the Hotel of the matters stipulated in Article 6, Paragraph 1, of the Act when required. (Article 6 of the Yamaguchi Prefectural Ordinances for Enforcement of the Hotel Business Act)
    8. When the Guest commits prohibited actions stipulated in the Hotel's Use Regulations (only for the purpose of fire prevention), such as smoking in bed and vandalizing fire protection facilities;
    9. When the Guest threatens violence, uses threats or extortion, or makes an unreasonable or coercive request to the Hotel or staff members (employees), or when the Guest requires the Hotel to assume a burden beyond a reasonable extent or is deemed to have acted previously in such a manner;
  2. 07.02. In the case when the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, the Hotel shall not be entitled to charge the Guest for any of the accommodation services, etc., which the Guest has not received yet.

Article 8 - Registration of Accommodation

  1. 08.01. The Guest shall be required to register the following particulars at the front desk of the Hotel on the day of accommodation:
    1. Name, age, sex, address, telephone number and occupation of the Guest;
    2. Nationality, passport number, port and date of entry in Japan and a copy of the passport in the case of a non-Japanese guest;
    3. Scheduled date and time of departure; and
    4. Other particulars deemed necessary by the Hotel.
  2. 08.02. In the case where the Guest intends to pay the accommodation charges prescribed in Article 12 by any alternative means other than currencies, such as traveler's cheques, accommodation coupons, and credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding paragraph.

Article 9 - Occupancy Hours of Guest Rooms

  1. 09.01. The Guest is entitled to occupy the contracted guest room of the Hotel from 4:00 p.m. to 10:00 a.m. of the following day. However, in the case when the Guest is accommodated continuously, the Guest may occupy it all day long, except for the days of arrival and departure.
  2. 09.02. The Hotel may, notwithstanding the provisions prescribed in the preceding paragraph, permit the Guest to occupy the room beyond the time prescribed in the same paragraph. In this case, extra charges shell be paid as follows;
    1. 30% of room charge for each excess hour

Article 10 - Compliance with Use Regulations of the Hotel

  1. 10.01. While staying in the Hotel, the Guest shall be required to comply with the Use Regulations that are established by the Hotel and posted within the premises of the Hotel.

Article 11 - Business Hours

  1. 11.01. The business hours of the main facilities, etc., of the Hotel are as follows, and those of other facilities, etc., shall be reported in detail by brochures as provided, notices displayed in each place, service directories in guest rooms and others.
    1. Service Hours of Front Desk, Cashier, etc.:
      1. Curfew: 0:00 a.m.
      2. Front Desk
      3. Front Exchange Service
    2. Drinking and Eating (Facilities) Service Hours:
      1. Starting Time for Breakfast: from 8:00 a.m. to 9:00 a.m.
      2. Starting Time for Lunch: from 11:00 a.m. to 1:00 p.m.
      3. Starting Time for Dinner: from 5:00 p.m. to 7:00 p.m.
  2. 11.02. The service hours described in the preceding paragraph may be changed temporarily due to unavoidable causes. In this case, the Guest shall be notified by proper means.

Article 12 - Payment of Accommodation Charges

  1. 12.01. The breakdown of the accommodation charges, etc., that the Guest shall pay is as listed in the attached Schedule I.
  2. 12.02. Accommodation Charges, etc., as stated in the preceding paragraph shall be paid in currencies or by other alternative means acceptable to the Hotel, such as traveler's cheques, accommodation coupons or credit cards, at the front desk at the time of departure of the Guest or upon request by the Hotel.
  3. 12.03. Accommodation Charges shall still be paid even in the case when the Guest does not stay at the Hotel at his/her discretion after the Hotel has offered a guest room and made it available for him/her to use.

Article 13 - Liabilities of the Hotel

  1. 13.01. In the case when the Hotel has caused damage to the Guest in the course of fulfillment of or due to non-fulfillment of the Accommodation Contract and/or related agreements, the Hotel shall compensate the Guest for such damage, except in the case when such damage has not been caused by reasons attributable to the Hotel.
  2. 13.02. The Hotel is covered by Hotel Liability Insurance in order to deal with unexpected fire and/or other disasters.

Article 14 - Handling When Unable to Provide Contracted Rooms

  1. 14.01. The Hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest, unless such arrangement is difficult due to natural disasters or other reasons.
  2. 14.02. Notwithstanding the provisions of the preceding paragraph, when unable to arrange other accommodation, the Hotel shall pay the Guest compensation money equivalent to the cancellation charges, which shall be applied to the reparations. However, when unable to provide a guest room due to causes not attributable to the Hotel, the Hotel shall not pay the Guest the compensation money.

Article 15 - Handling of Deposited Articles

  1. 15.01. The Hotel shall compensate the Guest for the damage when loss, breakage or other damage is caused to the goods, cash, or valuables deposited at the Front Desk by the Guest, except in the case when this has occurred due to causes of force majeure. However, for cash and valuables, when the Hotel has required the Guest to report its kind and value but the Guest has failed to do so, the Hotel shall compensate the Guest for the damage within the limits of 200,000 yen.
  2. 15.02. The Hotel shall compensate the Guest when loss, breakage, or other damage is caused, through intention or negligence on the part of the Hotel, to the goods, cash, or valuables that are brought onto the premises of the Hotel by the Guest but are not deposited at the front desk. However, for articles of which the kind and value have not been reported in advance by the Guest, the Hotel shall compensate the Guest within the limits of 150,000 yen, except in the case where loss, breakage or other damage was caused intentionally or by gross negligence on the part of the Hotel.

Article 16 - Custody of Baggage and/or Belongings of the Guest

  1. 16.01. When the baggage of the Guest is brought into the Hotel before his/her arrival, the Hotel shall be liable to keep it only in the case where such a request has been accepted by the Hotel. The baggage shall be handed over to the Guest at the Front Desk at the time of his/her check-in.
  2. 16.02. When the baggage or belongings of the Guest are found left after his/her checkout, and the ownership of the article is identified, the Hotel shall inform the owner of the article and ask for further instructions. However, when no instruction is given to the Hotel by the owner or when the ownership is not identified, the Hotel shall keep the article for seven days including the day it is found, and after this period, the Hotel shall turn it over to the nearest police station. As for umbrellas, clothing and other cheap items that take up space or require inappropriate amount of costs, the Hotel shall handle such items in accordance with the Lost Goods Act.
  3. 16.03. The Hotel's liability in regard to the custody of the Guest's baggage or belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of Paragraph 1 of the preceding article in the case of Paragraph 1 of this article, and with the provisions of Paragraph 2 of the same article in the case of Paragraph 2 of this article.

Article 17 - Liability in regard to Parking

  1. 17.01. The Hotel shall not be liable for the custody of the vehicle of the Guest when the Guest uses the parking lot within the premises of the Hotel, as it shall be regarded that the Hotel simply offers the space for parking, whether the key of the vehicle has been deposited to the Hotel or not. However, the Hotel shall compensate the Guest for the damage caused through intention or negligence on the part of the Hotel in regard to the management of the parking lot.

Article 18 - Liability of the Guest

  1. 18.01. The Guest shall compensate the Hotel for the damage caused through intention or negligence on the part of the Guest.

Article 19 - Countermeasures against Disaster

  1. The Guest shall be required to cooperate in taking preventive measures against disasters such as fire and earthquake and follow the instructions given by staff members and act in a calm manner in case of emergency. Please check the emergency exits, fire extinguishing equipment, evacuation procedures, etc., in advance and be prepared for unforeseeable circumstances.

Article 20 - Regulations of Condolence Money for the Guest

  1. The Hotel shall carry out the procedures stated in the Regulations of Condolence Money for the Guest that are stipulated separately in the event of the death of the Guest during his/her stay with the hotel due to causes other than an injury. (Schedule III: Regulations of Condolence Money for the Guest)

  1. The basic accommodation charge shall be as stated in the table of charges posted on the internet website.
  2. The charge for an elementary school child or younger is as follows:
    1. If a child takes meals and uses bedding on the same basis as an adult: 70% of the adult's charge
    2. If a child takes special meals for children and uses bedding for children: 50% of the adult's charge
    3. If a child only uses bedding: 30% of the adult's charge
    4. If a child (infant) does not take any meals or use bedding: 3,000 yen (not including consumption tax)
  3. If tax regulations are revised, charges shall be determined based on such revised regulations.

  1. The percentages signify the rate of the cancellation charge to the Basic Accommodation Charge.
  2. If the number of days for accommodation is reduced, the cancellation charges for one day (the first day) shall be charged, regardless of the number of days reduced.
  3. When part of a group booking (for 15 persons or more) is cancelled, the cancellation charge shall not be charged for the number of persons equivalent to 10% of the number of persons booked as of 10 days prior to the occupancy (When accepted less than 10 days prior to the occupancy, as of the date) with fractions counted as a whole number.

Schedule III: Regulations of Condolence Money for the Guest (Ref. Article 19)

Article 1- Purpose
  1. These Regulations provide for necessary matters concerning money and goods paid by the Hotel to express condolence in the event of the death of the Guest.
Article 2 - Special Payment for Death
  1. The Hotel shall do the following acts in the event of the death of the Guest during his/her stay with the hotel, due to causes other than an injury; the words "during his/her stay with the hotel" shall mean the time from his/her check-in at the hotel to the time of his/her check-out from the hotel:
    1. The Hotel shall pay the bereaved family of the Guest condolence money up to 100,000 yen per deceased Guest.
    2. Depending on circumstances, the Hotel shall send director(s) or employee(s) of the Hotel, or any other person appointed to represent the Hotel to the funeral of the deceased Guest.
    3. Depending on circumstances, the Hotel shall send flowers to the funeral of the deceases Guest.
Article 3 - Limitation of Benefits
  1. The Hotel shall be exempted from doing any of the acts stated in the preceding article, in the case where the death of the Guest is due to any of the following causes:
    1. Use of narcotics, opium, hemp, stimulant drugs, thinner, etc., by the Guest;
    2. Pregnancy, childbirth, premature birth, or miscarriage;
    3. A suicide attempt;
    4. Diseases caused by nuclear fuel materials (including used fuel materials; the same shall apply hereinafter) or materials contaminated by any of such nuclear fuel materials, other harmful qualities or accidents arising from such qualities;
    5. Diseases caused by nuclear radiation or radiation contamination other than those stated in the preceding item; or
    6. Bacterial food poisoning.
Article 4 - Submission of Documents
  1. The bereaved family of the deceased Guest shall be required to submit the following documents to the Hotel in order to receive condolence money in accordance with these Regulations:
    1. A prescribed request form for condolence money;
    2. A doctor's death certificate or postmortem report; and
    3. A document proving the relationship between the deceased Guest and the beneficiary.
